These terms govern your access to Kindlefish, including the website, free tools, paid plans, and Fee reports. By using Kindlefish, creating an account, starting checkout, redeeming a report credit, or downloading a report, you agree to these terms. If you do not agree, do not use the service.
What Kindlefish is
Kindlefish provides Amazon KDP keyword, category, and competitor research, free and paid research tools, subscriptions, and personalised listing-package reports. Kindlefish is decision-support software for authors. It is not a publisher, agent, advertising agency, accountant, lawyer, tax adviser, investment adviser, or Amazon representative.
Operator
Kindlefish is the trading and service name used for this website and tool. The service is operated by HMD Publishing in the United Kingdom. For support, legal notices, account questions, or refund requests, contact hello@kindlefish.io.
Not affiliated with Amazon
Kindlefish is an independent tool, not affiliated with or endorsed by Amazon. Kindle, Kindle Direct Publishing (KDP), and Amazon are trademarks of Amazon.com, Inc. You are responsible for complying with Amazon’s terms and for verifying that categories and keywords fit your listing before you use them.
References to Amazon, Kindle, KDP, Best Sellers Rank, ASINs, categories, keywords, ads, marketplaces, or similar terms describe compatibility, research context, or publicly available marketplace signals. They do not mean Amazon sponsors, approves, audits, validates, or guarantees Kindlefish or any Kindlefish output. We do not access your private Amazon, KDP, advertising, or seller account.
Eligibility and accounts
You must be able to enter a binding contract to use Kindlefish. You are responsible for activity under your account, keeping your sign-in method secure, and making sure the information you provide is accurate. Do not share access, resell access, pool accounts, or use multiple accounts to avoid fair-use limits, payment obligations, or abuse controls.
Your inputs and rights
You keep ownership of manuscripts, book details, keywords, titles, synopses, and other material you provide. You grant Kindlefish the limited permission needed to host, process, analyse, transform, display, email, and store those inputs so we can operate the service, generate reports, provide support, secure the service, and comply with law. You must have the right to upload or submit everything you provide.
Outputs and publishing decisions
Kindlefish outputs are research, estimates, suggestions, and generated copy or planning material. They are not guarantees of discoverability, ranking, sales, reviews, revenue, ad performance, category placement, Amazon acceptance, or publishing success. You are responsible for reviewing all outputs before use, checking them against Amazon’s current rules, and deciding whether they fit your book, audience, and risk tolerance.
AI and market-data tools can be incomplete, stale, inaccurate, or affected by marketplace changes. If an output matters commercially, you should verify it before relying on it.
Payments
Prices are shown at checkout and may vary by plan, promotion, country, tax treatment, or currency. Payments are processed by Stripe. You authorise Stripe and Kindlefish to charge the payment method you provide for purchases, renewals, applicable taxes, and any plan you select. We do not store full card numbers.
Pro is a recurring subscription unless stated otherwise. Monthly and annual subscriptions renew automatically until cancelled. You can cancel from your account or by contacting support; cancellation stops the next renewal and does not normally refund or prorate the current paid period. Fee report credits included with a plan have no cash value, are not transferable, and may expire or reset according to the plan rules shown in the product.
Digital content and immediate performance
Fee reports and paid research outputs are personalised digital content and/or digital services. When you start a paid report, redeem a report credit, tick the pre-purchase acknowledgement, or otherwise ask us to begin generation, you request immediate performance. Once generation has started, the report has been delivered, the report has been downloaded, or paid-only features have been used, refund rights are limited as explained in the Refund Policy and by any rights that cannot be excluded by law.
Acceptable use
- Do not scrape, crawl, bulk extract, mirror, copy, resell, sublicense, redistribute, or commercially exploit Kindlefish data, reports, prompts, workflows, or outputs except for your own book publishing work.
- Do not bypass rate limits, usage caps, security controls, account walls, checkout, download protections, or access controls.
- Do not upload unlawful, infringing, malicious, confidential third-party material, or material you do not have the right to use.
- Do not use Kindlefish to spam, mislead readers, infringe Amazon or third-party rules, generate unlawful advertising, or make deceptive publishing claims.
- Do not reverse engineer, interfere with, overload, test for vulnerabilities without permission, or attempt unauthorised access to Kindlefish or its providers.
Fair use and service controls
Free and paid usage may be subject to daily, monthly, technical, anti-abuse, or fair-use limits. “Unlimited” means ordinary interactive author use within technical and abuse-prevention limits; it does not permit automated extraction, resale, shared-team pooling, or unusually heavy usage that harms the service. We may throttle, suspend, or limit access to protect the service or other customers.
Third-party services
Kindlefish depends on third-party providers for hosting, authentication, payments, email, market data, AI processing, security, monitoring, and related infrastructure. Those services may change, fail, rate-limit, or return incomplete data. We are not responsible for third-party outages, marketplace changes, provider limitations, or Amazon policy changes outside our control, although we will use reasonable efforts to keep the service working.
Intellectual property
Kindlefish, the website, software, design, branding, prompts, internal workflows, models, data transformations, and non-customer content are owned by Kindlefish or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use Kindlefish for your own lawful book research and publishing work, subject to these terms. You may use generated report outputs for the book project for which they were generated, but you may not resell the service or create a competing data product from Kindlefish outputs.
Suspension and termination
We may suspend, restrict, or terminate access if you breach these terms, create legal or security risk, abuse fair-use limits, fail to pay, misuse refunds or chargebacks, or use the service in a way that harms Kindlefish, providers, customers, authors, readers, or third parties. You may stop using Kindlefish at any time. Termination does not remove obligations that should reasonably survive, including payment, intellectual-property, acceptable-use, disclaimer, liability, indemnity, and dispute terms.
Privacy
The Privacy Policy explains how we collect, use, share, store, and delete personal data.
Disclaimers & liability
Kindlefish is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, data accuracy, model accuracy, commercial outcome, and marketplace result.
To the fullest extent permitted by law, Kindlefish is not liable for indirect, incidental, special, punitive, exemplary, or consequential losses; lost profits; lost sales; lost rankings; lost reviews; lost goodwill; wasted ad spend; loss of data; marketplace penalties; Amazon listing outcomes; or publishing decisions made using the service. Kindlefish’s total liability for all claims is limited to the amount you paid to Kindlefish for the affected service in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law.
Indemnity
To the fullest extent permitted by law, you agree to reimburse and hold Kindlefish harmless from claims, losses, liabilities, costs, and expenses arising from your inputs, your breach of these terms, your misuse of the service, your publishing decisions, your advertising, your Amazon or KDP activity, or your violation of third-party rights or law.
Disputes and governing law
Please contact us first so we can try to resolve any issue informally. These terms are governed by the laws of England and Wales, except where consumer law gives you mandatory rights in another location. The courts of England and Wales will have jurisdiction, except where applicable consumer law requires otherwise. Where permitted by law, claims must be brought within one year of the event giving rise to the claim.
Changes
We may update these terms as Kindlefish changes. The date above shows when this version took effect. Continued use after changes take effect means you accept the updated terms.
